Bush included bailout loophole to allow CEO payouts
Helping friends until the bitter end. Only this Congress - who has been much too shy about taking control during the end of one of the most failed administrations in decades - could allow this to happen. The Democrats are going to have to do much better than this because the only thing they have going now is chaos within the GOP ranks. The Democrats make it so hard to respect them as a power when they blow every imaginable opportunity that they face.
Congress wanted to guarantee that the $700 billion financial bailout would limit the eye-popping pay of Wall Street executives, so lawmakers included a mechanism for reviewing executive compensation and penalizing firms that break the rules.
But at the last minute, the Bush administration insisted on a one-sentence change to the provision, congressional aides said. The change stipulated that the penalty would apply only to firms that received bailout funds by selling troubled assets to the government in an auction, which was the way the Treasury Department had said it planned to use the money.
Now, however, the small change looks more like a giant loophole, according to lawmakers and legal experts. In a reversal, the Bush administration has not used auctions for any of the $335 billion committed so far from the rescue package, nor does it plan to use them in the future. Lawmakers and legal experts say the change has effectively repealed the only enforcement mechanism in the law dealing with lavish pay for top executives.

WASHINGTON – The Bush administration backed off proposed crackdowns on no-money-down, interest-only mortgages years before the economy collapsed, buckling to pressure from some of the same banks that have now failed. It ignored remarkably prescient warnings that foretold the financial meltdown, according to an Associated Press review of regulatory documents.
"Expect fallout, expect foreclosures, expect horror stories," California mortgage lender Paris Welch wrote to U.S. regulators in January 2006, about one year before the housing implosion cost her a job.
Bowing to aggressive lobbying — along with assurances from banks that the troubled mortgages were OK — regulators delayed action for nearly one year. By the time new rules were released late in 2006, the toughest of the proposed provisions were gone and the meltdown was under way.
"These mortgages have been considered more safe and sound for portfolio lenders than many fixed rate mortgages," David Schneider, home loan president of Washington Mutual, told federal regulators in early 2006. Two years later, WaMu became the largest bank failure in U.S. history.
The administration's blind eye to the impending crisis is emblematic of its governing philosophy, which trusted market forces and discounted the value of government intervention in the economy. Its belief ironically has ushered in the most massive government intervention since the 1930s.

Never before has a president pardoned himself or his subordinates for crimes he authorized. The closest thing to this in U.S. history thus far has been Bush's commutation of Scooter Libby's sentence. Bush is widely expected to follow that commutation with a pardon. Not only did Libby work for the White House, but he was convicted of obstruction of justice in an investigation that was headed to the president. Evidence introduced in the trial, including a hand-written note by the vice president, implicated Bush, and former press secretary Scott McClellan has since testified that Bush authorized the exposure of an undercover agent, that being the crime that was under investigation.

JACKSONVILLE, Fla. --- Election officials scrutinizing absentee ballots in Duval County have rejected more than 500 ballots out of the 1,600 questionable ballots examined so far.
Most of those were rejected because they lack signatures or the signatures don't match the voter's signature on file.
Lisa Rigg was worried her signature didn't match and contacted the Supervisor of Elections office.
"It's that important to me. I want my vote to absolutely count for this election. It is very important," Rigg said.
She was right. Her absentee vote is one of those that was rejected.
"I was a little shocked," Rigg said. "But then again, my signature does not always match, from day to day. I said, 'What can I do to fix this? Can I come down and prove to you that I am who I am and I signed that ballot.'"
Unfortunately, the answer was no. Once a ballot is cast, it cannot be changed or replaced by a new ballot.

John McCain (R-AZ) scrambled “to recast himself as a champion of regulation” in order to erase his past support of legislation “to broadly deregulate the banking and insurance industries helping to sweep aside a thicket of rules established over decades.”
But McCain has had a tough time sticking with his new pro-regulation message. After meeting with small business owners in Colorado yesterday, McCain released a statement emphasizing the need for “less government regulation of their business.” Politico’s Lisa Lerer notes that this is “a dangerous message in the midst of a market meltdown many have blamed on a lack of regulation on Wall Street.”

Barack Obama and the Democrats are stealing the election. Massive voter fraud is being carried out, even as we speak, by their henchmen, known by the innocuous sounding Association for Community Organisations for Reform Now, or Acorn. Clever bastards.
The only problem? Despite the screaming wall-to-wall coverage of "Democratic voter fraud in 11 swing states" as seen on Fox News and even the once-respectable CNN, none of it's true. None of it.
In just the last week, we've had a phoney stunt raid in swing state Nevada (where Acorn had been cooperating with officials for months, concerning problem canvassers they'd long ago fired); a Republican election official in swing state Missouri tell Fox News that she's being beseiged with fraudulent registration forms from Acorn (in a county where they've not done any registration work since August); a Republican sheriff in swing state Ohio, who, the very next day, suddenly requested the names and addresses of hundreds of early voters (with evidence of exactly zero wrong doing, but lots of Democratic-leaning college student in the particular county, and John McCain's state campaign chair as a partner in the investigation); and a screaming front page headline in Rupert Murdoch's New York Post about a guy who claims he was somehow tricked by Acorn into registering 72 times (but read the article closely to note he says he registered at the same address each time, which, even if true, would allow him - you guessed it - precisely one legal vote.)
It's an old Republican scam, but it's never been carried out with more zeal than this year. The Republicans have been putting so much time, money and resources into the propaganda leading up to this over the last four years, we should have expected no less.

I'm Very Bummed About Opus..
Berkeley Breathed's 'Opus' Comic Strip Will End Next Month

NEW YORK "Opus" is ending Nov. 2, Washington Post Writers Group (WPWG) Comics Editor Amy Lago announced this afternoon.
In this Sept. 8 blog post, E&P had wondered if Berkeley Breathed might pull the plug on his Sunday-only strip -- given all the hints the cartoonist was making about that in his comic.
"Opus," which began almost five years ago, will be the third comic Breathed ends. The first and most famous was the Pulitzer Prize-winning "Bloom County" (1980-1989), followed by "Outland" (1989-1995). "Bloom County" had about 1,300 clients when it stopped.
Breathed, who has done a number of children's books, insists that this time he's getting out of the comics business for good. He joked in a statement that the best way he can help his country during the current financial and political crisis is to "write funny stories for America's kids. I call on John McCain to join me."
WPWG Editorial Director/General Manager Alan Shearer praised Breathed, saying the cartoonist "pushed all sorts of topical and stylistic envelopes" and "influenced a generation of new cartoonists."
Lago said Breathed is ending his comic with a contest asking readers to guess Opus the penguin's fate. Currently, the character is in prison courtesy of U.S. authorities. The actual solution will be available only on the Internet, not in newspapers, according to WPWG.
In addition to doing children's books, Breathed in recent years has worked on screenplays and novels. His "Pete & Pickles" kids' book is due in stores Oct. 16, and the Californian is finishing a novel for young readers called "Flawed Dogs."

As Bush attempts to stabilize his crashing economy, we are witness to the final chapter of a period of
perverse and dishonest leadership that has used its own crises to justify the expansion of its own power.
This little boy came to office on promises of modesty -- who championed a "humble nation," scorned nation
building and promised a more limited role for government in the lives of its citizens. Then he presided over a
six-year attempt to tear down and rebuild the nations of Afghanistan and Iraq, and now has embarked on the
most profound expansion of the federal government's role in the private economy since the Depression.
In both cases, the pattern is the same. Ineptitude led to crisis; crisis then became the argument for the
radical expansion of executive power. The administration insisted that it exercise its new authority with
a minimum of scrutiny by Congress, the courts or the public...
These troubles are about more than a president who is unfaithful to his word. Bush has transformed the
balance of power in our government. We are seeing the erection of an imperial presidency, immune from
oversight when it fights terrorists and when it rescues banks."
Bush is immune from oversight because the wet-my-pants Democrats allow him to break the law.

To return in 4 years..
Maybe just maybe, he can get it going at the State level first..I hope so..

Tax the Speculators: A Fair Plan to Fund Recovery

With the specter of financial Armageddon raised in headlines everywhere, two questions keep occurring to me. Where will the government find the $85 billon to bail out AIG and other Wall Street giants? And how will we pay for the proposed Main Street recovery, including federal aid to states, relief to homeowners, and public works projects for the unemployed?
The Bush administration plans to add to the $400 billion projected deficit and our $9 trillion national debt. But it's irresponsible to shift the bill entirely to the next generation. The corporations that rigged the casino economy and the wealthy CEOs and investors that profited at everyone else's expense should bear the recovery costs, not our kids and grandchildren.
We can't recover the money from the companies now. They have extracted the profits and their CEOs have cashed their gilded paychecks. The speculators bought mansions, private jets, and small islands. Lehman Brothers declared bankruptcy on Monday and 25,000 workers are on the brink of unemployment. But Lehman CEO Richard Fuld is sitting pretty, with his $354 million compensation from the last five years and a mega-mansion in Greenwich, Connecticut.
When a CEO or employee improperly takes money from a company and is forced to pay it back, it is colorfully referred to as "disgorgement." In 1999, managers of Compaq Computer cooked the books and gorged on bonuses based on misrepresented profits. The government forced them to pay it back.

The Associated Press-National Constitution Center poll of views on the Constitution found people wary of governmental authority after years of controversy over the Bush administration's expansion of executive power, and especially skeptical of increasing the president's powers.
"There is clearly a concern about executive power and the balance of power that comes out in a couple of different ways," said Joseph Torsella, president of the Philadelphia-based organization. The nonpartisan center is dedicated to educating the public about the Constitution.
Torsella said he believes the polls reflect long-standing skepticism of presidential power. "I think it's a basic chord in the American song and it gets louder and stronger depending on what's happening in the headlines," he said.

President Bush and Congress are at record low approval ratings in recent polls, with Congress even less popular than the president. But in the new poll, the public is more reluctant to expand the president's powers than those of Congress.
Two-thirds of Americans oppose altering the balance of power among the three branches of government to strengthen the presidency, even when they thought that doing so would improve the economy or national security. People were more evenly split over giving Congress more power in the same circumstances.
"The Constitution sets up three branches of government and to increase the power of one at the expense of the others endangers the fundamental structure," said poll participant James Crowder, 74, of Cockeysville, Md., a Baltimore suburb. "This current president and his vice president have distorted the office of president so much that it will take an enormous amount of time, if ever, for us to recover from that." Crowder is a Democrat and a retired Episcopal priest.
In one area, the poll found Americans clearly on Congress' side. They said Congress should have the power to require senior presidential aides to testify before House and Senate committees — a topic currently wending its way through the courts. The administration is trying to prevent former White House counsel Harriet Miers from testifying about the firing of nine U.S. attorneys.

They've been running Washington like a well-oiled machine, to the point of inviting lobbyists into the back rooms to write the legislation, and now they are anti-establishment reformers dedicated to delivering us from themselves.
And Giuliani is an advocate for small-town America. Bravo.
They are coming out for Small Efficient Government the very week that the feds are taking over Fannie and Freddie, those old cash cows, and in the course of a weekend 20 or 50 or (pick a number) billion go floating out the Treasury door.

Diebold Coverup, Says SAIC Report And Stephen Spoonamore

We have been asserting for years that Diebold (now Premier Elections Systems) makes voting machines that don’t work, are unreliable and that have flipped elections. Just last week, Diebold was forced to admit that software in its machines has for a decade been dropping votes. These machines are being used in 34 states in the upcoming election.
Two years ago, The Brad Blog broke the Pentagon Papers of E-Voting stories about the SAIC report on the vast problems with Diebold vote machines. In short, Diebold had issued a 40 page redacted version of the SAIC report which whitewashed the problems. Computer cyber security expert Stephen Spoonamore got a copy of the 197-page unredacted report which listed hundreds of serious problems, and he released that report to us.
Well, Spoonamore did more than that – he took the report to the Maryland Board of Elections and confronted them with it at a public meeting. He told them that if he were handed such a report in the private sector, he would “shut down the system and open a fraud investigation.” The elections officials expressed shock that they had not ever seen the same unredacted report. And when the meeting was over, Spoonamore, with a concealed microphone, personally confronted the officials. And what did one of them say to him – that him having the report was “a security risk.” Following the confrontation, Spoonamore was contacted by law enforcement officials who demanded to know how he got the report. We can say now that the report came from a high official in the Executive Branch who wanted to expose Diebold.

Seder vs. Maron: The comeback ?

It sounds like an idea so obviously stupid-proof that it almost couldn't possibly have come from the executive office at Air America Media.
Exiled hosts Marc Maron and Sam Seder re-launched their video podcast program last Friday, and to celebrate, offered up a big announcement. The two will be posting a new show every day between now and the November 4 election, as well as from this week's Democratic National Convention in Denver. And both hosts also stated that they have also been offered a new show on Air America - working as a team.
According to Rebecca O'Malley at The Resilient Rabbit, Maron claimed that the new show, which will supposedly begin in September, will included a number of creative humor elements as well as straight political commentary. Maron may even bring back some of his classic team from his old Morning Sedition show.
So far, that is all that is known about Seder vs. Maron. No time slot has been disclosed, though the most obvious shift would be morning drive, 6-9A ET, which is currently airing previous day replays of other Air America programming.

WASHINGTON — Disclosure of an election computer glitch that could drop ballot totals for entire precincts is stirring new worries that an unofficial laboratory testing system failed for years to detect an array of flaws in $1.5 billion worth of voting equipment sold nationwide since 2003.
Texas-based Premier Elections Solutions last week alerted at least 1,750 jurisdictions across the country that special precautions are needed to address the problem in tabulation software affecting all 19 of its models dating back a decade.
Voting experts reacted skeptically to the company's assertion that election workers' routine crosschecks of ballot totals would have spotted any instances where its servers failed to register some precinct vote totals when receiving data from multiple memory cards.
Like nearly all of the nation's modern voting equipment, Premier's products were declared "qualified" under a voluntary testing process overseen from the mid 1990s until 2005 by the National Association of State Election Directors.
Computer scientists, some state officials and election watchdog groups allege that the NASED-sponsored testing system was a recipe for disaster, shrouded in secrecy, and allowing equipment makers to help design the tests.
The federal Election Assistance Administration, created in 2002, took over the testing responsibility in 2005, but has yet to certify a single voting machine.
As a result, charged Susan Greenhalgh, a spokeswoman for watchdog group Voter Action, the systems on which Americans will decide the race between Barack Obama and John McCain in November are "scandalously flawed"' and "the integrity of this election is in question."
David Beirne, executive director of the Election Technology Council, which represents the leading makers of voting machines, said there's no reason for concern. Without mentioning NASED, he said that members' products "have all been certified" as meeting 2002 voluntary federal standards.
NASED officials took on the testing in the mid 1990s, after the Federal Election Commission adopted voluntary federal standards for voting machines but Congress failed to create a testing agency. The industry was frustrated, too, by being governed by a hodge-podge of state standards.
"We had two choices: To try to do something or to do nothing," said Thomas Wilkey, who headed NASED's volunteer Voting Systems Committee for several years while executive director of New York's elections board. "We had a set of standards. It was a crime to let them sit on a shelf."
NASED watched over the issuance of "qualified" reports from Independent Testing Laboratories, but with little control over the testing. The vendors secretly negotiated payments with the labs, helped design the tests, got to see the results first and only shared the codes driving their software with three NASED technical experts who signed non-disclosure agreements.
NASED officials posted only "qualified" ratings on the group's Web site.
The lab endorsements aided vendors in selling nearly $1.5 billion in equipment to states and counties from 2003-2007, most of it financed by a gush of federal dollars under the 2002 Help America Vote Act.
Wilkey says the labs' approval was never a "certification." But EAC members have referred publicly to NASED's "certification" of voting machines, and numerous states enacted laws barring purchases of equipment unless it passed the NASED-sponsored tests.
Questions about NASED's testing grew in intensity over the last couple of years, after independent tests for the states of California, New York, Ohio, Florida and Connecticut found performance defects and security gaps in both systems that will serve most voters this fall: touch-screens and optical scanners.
The concerns prompted New York's elections board to scrap a $60 million contract to buy new touch screens to replace its decades-old lever voting machines. Vice Chair Douglas Kellner said it's now clear that a "qualified" rating from NASED is "meaningless ...a piece of toilet paper."
David Jefferson, a voting machine security expert who works at the Lawrence Livermore National Laboratory, said NASED's tests were "of no value if your concern is security against insider threats," such as tampering by election officials.
John Washburn, a software tester in the Milwaukee suburb of Germantown, predicts that nearly all of the machines bought in recent years will have to be replaced in a process he likened to the early 20th Century Teapot Dome scandal "as just the epitome of how government money goes down a rat hole," he said.
Worries about the touch-screens' lack of a verifiable paper trail have already prompted states to replace thousands of barely used machines costing hundreds of millions of dollars in favor of the scanners, which preserve each voter's original paper ballot for use in a recount.

With less than three months before the presidential election, the hotly contested state, Ohio, along with others, continue to have problems with E-voting technology

In their rush to avoid a repeat of the controversy that plagued the 2000 presidential election, and to meet the requirements of Congress's hastily mandated 2002 Help America Vote Act (HAVA), states and counties flocked to electronic voting systems they hoped would eliminate hanging chads and other flaws inherent in paper-based systems. Six years later, with another presidential election less than three months away, many e-voting systems are fraught with security glitches, and the technology has yet to prove itself as the solution voters were looking for.
Such systems could allow voters and poll workers to place multiple votes, crash the systems by loading viruses, and fake vote tallies, according to studies commissioned by the states of California and Ohio within the past year. Makers of these systems have countered that the test settings were unrealistic. But that is not helping election officials sleep better at night.
One of the reasons e-voting systems turned out to be such a failure is that the only people involved in checking these systems were the vendors, who wanted to sell their technology, and the local election officials, who were ill-equipped to understand the security issues, says David Dill, a Stanford University computer science professor and founder of the Verified Voting Foundation, a nonprofit organization pushing for the implementation of voting processes that can more easily be verified and audited. "There was a certification process in place," Dill says, "but it had very little to do with security."
Dill is the author of Attackdog, threat modeling software that can examine more than 9,000 potential ways a voting system can be attacked, including computer hacking, ballot tampering and voter impersonation. Attackdog is part of a larger effort called A Center for Correct, Usable, Reliable, Auditable and Transparent Elections (ACCURATE) , which was launched in 2005 by the National Science Foundation with $7.5 million in funding. "Nothing we do now will affect the November election," Dill says. "We don't know how to make secure paperless voting."
This sentiment is echoed in many places throughout the U.S., most prominently in the hotly contested state of Ohio, where Secretary of State Jennifer Brunner has commissioned a series of tests over the past year to determine whether e-voting systems are secure enough to be trusted. Based on these tests Brunner has concluded that they are not secure, a decision that Premier Election Solutions, Inc., in Allen, Tex., took exception to. Premier sued Brunner and one Ohio county board of elections in May in a move to get the courts to rule that the company had fulfilled its contractual obligations to the state.
Brunner struck back August 6 by countersuing Premier, formerly Diebold Election Systems, Inc., and maker of the touch-screen voting systems into which Ohio has invested more than $62 million since 2005. Brunner's suit accuses Premier of, among other things, breach of contract and breach of warranty, and seeks court acknowledgement that Premier did not honor its contract. The countersuit also asks for damages of at least $25,000 against Premier for voting system malfunctions that have caused problems in at least 11 of the 44 counties using Premier's technology during elections since 2005. "We believe that Premier's equipment has failed to perform as required by its contracts and according to state law," Brunner says. "We have taken this action to recover taxpayer funds spent for voting systems used in half of the state's 88 counties."

In their rush to avoid a repeat of the controversy that plagued the 2000 presidential election, and to meet the requirements of Congress's hastily mandated 2002 Help America Vote Act (HAVA), states and counties flocked to electronic voting systems they hoped would eliminate hanging chads and other flaws inherent in paper-based systems. Six years later, with another presidential election less than three months away, many e-voting systems are fraught with security glitches, and the technology has yet to prove itself as the solution voters were looking for.
Such systems could allow voters and poll workers to place multiple votes, crash the systems by loading viruses, and fake vote tallies, according to studies commissioned by the states of California and Ohio within the past year. Makers of these systems have countered that the test settings were unrealistic. But that is not helping election officials sleep better at night.
One of the reasons e-voting systems turned out to be such a failure is that the only people involved in checking these systems were the vendors, who wanted to sell their technology, and the local election officials, who were ill-equipped to understand the security issues, says David Dill, a Stanford University computer science professor and founder of the Verified Voting Foundation, a nonprofit organization pushing for the implementation of voting processes that can more easily be verified and audited. "There was a certification process in place," Dill says, "but it had very little to do with security."
Dill is the author of Attackdog, threat modeling software that can examine more than 9,000 potential ways a voting system can be attacked, including computer hacking, ballot tampering and voter impersonation. Attackdog is part of a larger effort called A Center for Correct, Usable, Reliable, Auditable and Transparent Elections (ACCURATE) , which was launched in 2005 by the National Science Foundation with $7.5 million in funding. "Nothing we do now will affect the November election," Dill says. "We don't know how to make secure paperless voting."
This sentiment is echoed in many places throughout the U.S., most prominently in the hotly contested state of Ohio, where Secretary of State Jennifer Brunner has commissioned a series of tests over the past year to determine whether e-voting systems are secure enough to be trusted. Based on these tests Brunner has concluded that they are not secure, a decision that Premier Election Solutions, Inc., in Allen, Tex., took exception to. Premier sued Brunner and one Ohio county board of elections in May in a move to get the courts to rule that the company had fulfilled its contractual obligations to the state.
Brunner struck back August 6 by countersuing Premier, formerly Diebold Election Systems, Inc., and maker of the touch-screen voting systems into which Ohio has invested more than $62 million since 2005. Brunner's suit accuses Premier of, among other things, breach of contract and breach of warranty, and seeks court acknowledgement that Premier did not honor its contract. The countersuit also asks for damages of at least $25,000 against Premier for voting system malfunctions that have caused problems in at least 11 of the 44 counties using Premier's technology during elections since 2005. "We believe that Premier's equipment has failed to perform as required by its contracts and according to state law," Brunner says. "We have taken this action to recover taxpayer funds spent for voting systems used in half of the state's 88 counties."

Oklahoma is one state which owns its own voting system and wasn't tempted by the offer of federal funds in 2002 to switch over to a proprietary system. "There was really nothing on the market we would buy then," Michael Clingman of the Oklahoma State Election Board told CNN, "and there's still nothing we would want to buy today."
"Oklahoma is a real piece of America!" Dobbs commented approvingly. "They're telling these silly son-of-a-guns to go stick it -- and they're honoring a commitment to the public."
Dobbs promised to post a list of every state or county that is outsourcing the vote on his Web site.

On 7/15/08, Rep. Dennis Kucinich introduced H.Res. 1345, one Article of Impeachment Against President Bush.
H.Res. 1345 says Bush should be impeached because he "deceived Congress with fabricated threats of Iraq Weapons of Mass Destruction (WMD) to fraudulently obtain support for an authorization for the use of force against Iraq and used that fraudulently obtained authorization, then acting in his capacity under Article II, Section II of the Constitution as Commander in Chief, to commit US troops to combat in Iraq."
The evidence that Rep. Kucinich has presented for this charge is overwhelming. It is imperative to Impeach George Bush both to hold him accountable for his crimes and to deter future Presidents from committing similar crimes.
I would like a response to this email but,Not one of your Stale Form Emails stating the that were too busy,it would be to bothersome,it would be partisan..

It sickens me to think that Zoe Baird and Kimba Wood were disqualified as choices for Attorney General because of nanny taxes and yet we get Attorneys General who believed in stomping on the Constitution (Ashcroft), approve of voter suppression and torture as well as lie to Congress and reporters (Gonzales) and who think torture is only torture if it is done to him, won’t prosecute or investigate crimes committed by the Executive Branch and now thinks that not all violations of the law are crimes (Mukasey).
Thanks for that last one, Senators Schumer and Feinstein.
Whether you look at the "regular" definition of the word "crime" or even the legal definition, you will find the most basic "violation of law" as part of the definition.

I’m sure that I missed more than a few, but I am glad that having a funny sounding name or names that sound similar to names that sound funny are worthy of indefinite detaining or "errors". And living in a house that wasn’t even the house that SWAT teams were supposed to be looking for is their own fault when they are raided or wrongfully arrested.
Torture. Fabricate evidence to invade another country. Violate laws in hiring and firing practices. Suppress the vote illegally. Violate the fourth amendment. Blow the cover of a covert CIA operative and an entire network of people working on WMD issues. Break campaign finance laws. Ignore subpoenas.
Go ahead - those aren’t crimes and there certainly is a precedent for not being prosecuted.
Just don’t wear a shirt that has a cartoon robot on it while trying to fly or, even worse, wear a t shirt that says "Give Peace A Chance". Because those are not only most certainly not in any way violations of the law, but are also crimes.

US Attorney General Mukasey apparently forgets that he works for the American people, not for the White House. He also forgets we are a country of laws, not of men. So his latest shocker is not only a cover-up, politically based and with complete disregard for the law, but it is also obstruction of justice, for which he should be prosecuted. From Think Progress:
In a speech today before the American Bar Association (ABA), Mukasey was more explicit in his rejection of any sort of review or prosecution, saying that the “negative publicity” they faced was enough:
That does not mean, as some people have suggested, that those officials who were found by the joint reports to have committed misconduct have suffered no consequences. Far from it. The officials most directly implicated in the misconduct left the Department to the accompaniment of substantial negative publicity. … To put it in concrete terms, I doubt that anyone in this room would want to trade places with any of those people.
Mukasey also reiterated that these former employees were not found to be in violation of any criminal laws. They did, however, violate civil service laws. A joint report by the Inspector General and the Office of Professional Responsibility found that in particular, Michael Elston, formerly the chief of staff to the Deputy Attorney General, “violated federal law and Department policy” by selecting candidates based on their political affiliations.
Clearly, the Bush administration seems to be betting that it will be able to escape any accountability for its misdeeds once it leaves office. In the meantime, officials are just running out the clock.
Well then, next time any American citizen breaks the law, feel free to cite Mukasey's (unofficial) ruling (as a judge?) that embarrassment is more than enough punishment. I also find it remarkable that Mukasey thinks that this entire scandal is about DOJ officials and their hiring practices. What of the US Attorneys who have and continue to abuse their power in targeting Democrats, and in some cases cooking the evidence against them? What of those alleged crimes and the victims of those crimes? Senator Schumer should feel ashamed for his role in getting Mukasey seated as the AG.

There she was on The View on Monday, and Joy Behar, a good progressive, actually asked her a decent question on why she wasn’t pursuing impeachment.
Pelosi’s response was unbelievable: “If somebody had a crime that the president had committed, that would be a different story.”
You’ve got to be kidding me!
For starters, Bush himself admitted that he wasn’t obeying the FISA law when he was spying on people without first getting a warrant from the FISA court as required explicitly in the statute.
Then there is the torture and kidnapping that he has countenanced. That violates U.S. statutes and treaties.
And what about the wholesale corrupting of the Justice Department, which pursued political prosecutions and illegally discriminated against prospective employees on the basis of their personal views?
Then there’s the outing of Valerie Plame, and the cover up of that outing.
And what greater crime can you commit than waging a war of aggression and lying a country into war?
The evidence on impeachment, as Dennis Kucinich has courageously and thoroughly demonstrated, is overwhelming. On Democracy Now, Kucinich responded to Pelosi’s claim.

On 7/15/08, Rep. Dennis Kucinich introduced H.Res. 1345, one Article of Impeachment Against President Bush.
H.Res. 1345 says Bush should be impeached because he "deceived Congress with fabricated threats of Iraq Weapons of Mass Destruction (WMD) to fraudulently obtain support for an authorization for the use of force against Iraq and used that fraudulently obtained authorization, then acting in his capacity under Article II, Section II of the Constitution as Commander in Chief, to commit US troops to combat in Iraq."
The evidence that Rep. Kucinich has presented for this charge is overwhelming. It is imperative to impeach George Bush both to hold him accountable for his crimes and to deter future Presidents from committing similar crimes.

Judiciary Committee Chairman Conyers and Committee Members,
Hold Karl Rove in contempt !
This is a guy who has told Congress that he will not show up under subpoena unless he is not sworn to tell the truth, unless he has the questions in advance, and unless he is assured that nobody is writing down his answers. Now does that sound like somebody who's prepared to tell the truth?

We won't know the truth until Congress digs it out.

Karl Rove needs to be held in contempt, needs to be arrested, needs to be brought in and made to sit before Congress and answer questions.

There's no need for Obama nor anyone else to vote on the FISA bill now, it's unnecessary thanks to a Bush-appointed Appeals Court judge.

A federal judge in California said Wednesday that the wiretapping law
established by Congress was the “exclusive” means for the president to
eavesdrop on Americans, and he rejected the government’s claim that the
president’s constitutional authority as commander in chief trumped that

He said the rules for surveillance were clearly established by Congress in 1978 under the Foreign Intelligence Surveillance Act, which requires the government to get a warrant from a secret court.
“Congress appears clearly to have intended to — and did — establish

conducted,” the judge wrote.
“Whatever power the executive may

With my late Wife Laurie and her girlfriend Cheryl..
The band is from Tempe AZ.
They were Very Good..
I wish I could have seen them with their Original Lead Guitar Player,too..(Doug..Sorry..Can't remember his last name.)
He was the guy who wrote almost all of their songs..
He unfortunately killed himself..
He was a very talented song writer..
I first heard them on the radio like everyone else."Hey Jealousy".
I'd just had a operation and needed to walk alot to break up scar tissue..(What fun ! Not !)
So I bought their tape and took off a walkin with my trusty Walkman..
I walked all over my damn town..

Martian soil appears able to support life

LOS ANGELES (Reuters) - "Flabbergasted" NASA scientists said on Thursday that Martian soil appeared to contain the requirements to support life, although more work would be needed to prove it.
Scientists working on the Phoenix Mars Lander mission, which has already found ice on the planet, said preliminary analysis by the lander's instruments on a sample of soil scooped up by the spacecraft's robotic arm had shown it to be much more alkaline than expected.
"We basically have found what appears to be the requirements, the nutrients, to support life whether past present or future," Sam Kounaves, the lead investigator for the wet chemistry laboratory on Phoenix, told journalists.
"It is the type of soil you would probably have in your back yard, you know, alkaline. You might be able to grow asparagus in it really well. ... It is very exciting for us."

We strongly urge our colleagues to reject this so-called ‘compromise’ legislation and oppose any efforts to consider this bill in its current form. Never appease political bullies, President Bush admonished at the Israeli Knesset," MSNBC's Keith Olbermann opened. "Oddly, House Democrats chose to ignore him on the subject of dealing with him."
Constitutional expert Jonathan Turley sees a "very frightening bill" in a proposed "compromise," currently in the House, that would update the 1978 Foreign Intelligence Surveillance Act to effectively grant immunity from civil lawsuits to telecommunications companies that agreed to spy on their customers as part of the National Security Agency's warrantless wiretapping program, starting shortly (before) the World Trade Center attacks in 2001. If the White House asked a phone company to spy with its assurance that it was legal, the measure says, that's enough to dismiss a case.
Congressional Democrats, Turley went on, knew about surveillance and torture programs, but were politically unable to oppose them at the same time they were touting themselves to the public as defenders of civil liberties. The bill, he said, is part of a campaign of collusion between Congress and the Bush administration, immunizing not only the telecommunications companies, but the administration and any members of Congress, on either side of the aisle, that may have been involved.
"The proposed FISA deal is not a compromise; it is a capitulation," Senator Russ Feingold said today. "The House and Senate should not be taking up this bill, which effectively guarantees immunity for telecom companies alleged to have participated in the President’s illegal program, and which fails to protect the privacy of law-abiding Americans at home.(Allowing courts to review the question of immunity is meaningless when the same legislation essentially requires the court to grant immunity.) (And under this bill, the government can still sweep up and keep the international communications of innocent Americans in the U.S. with no connection to suspected terrorists, with very few safeguards to protect against abuse of this power.) (Instead of cutting bad deals on both FISA and funding for the war in Iraq, Democrats should be standing up to the flawed and dangerous policies of this administration.")
"The Democrats never really were engaged in this," said Turley. "In fact, they repeatedly tried to cave in to the White House, only to be stopped by civil libertarians and bloggers."
"I think they're simply waiting to see if the public's interest will wane," he went on, referring to repeated attempts to float said legislation past the public. "This bill has quite literally no public value for citizens or civil liberties. It is reverse engineering, though the type of thing the Bush Administration's famous for, and now the Democrats are doing--that is, to change the law to conform to past conduct."
"It's what any criminal would love to do," Turley continued. "You rob a bank, go to the legislature, and change the law to say that robbing banks is lawful."
"People need to be very, very much aware of this bill," he charged. "What you're seeing in this bill is an evisceration of the Fourth Amendment of the Constitution. It is something that allows the President and the government to go into law-abiding homes, on their word alone--their suspicion alone--and to engage in warrantless surveillance.
