Diebold Coverup, Says SAIC Report And Stephen Spoonamore

We have been asserting for years that Diebold (now Premier Elections Systems) makes voting machines that don’t work, are unreliable and that have flipped elections. Just last week, Diebold was forced to admit that software in its machines has for a decade been dropping votes. These machines are being used in 34 states in the upcoming election.

Two years ago, The Brad Blog broke the Pentagon Papers of E-Voting stories about the SAIC report on the vast problems with Diebold vote machines. In short, Diebold had issued a 40 page redacted version of the SAIC report which whitewashed the problems. Computer cyber security expert Stephen Spoonamore got a copy of the 197-page unredacted report which listed hundreds of serious problems, and he released that report to us.

Well, Spoonamore did more than that – he took the report to the Maryland Board of Elections and confronted them with it at a public meeting. He told them that if he were handed such a report in the private sector, he would “shut down the system and open a fraud investigation.” The elections officials expressed shock that they had not ever seen the same unredacted report. And when the meeting was over, Spoonamore, with a concealed microphone, personally confronted the officials. And what did one of them say to him – that him having the report was “a security risk.” Following the confrontation, Spoonamore was contacted by law enforcement officials who demanded to know how he got the report. We can say now that the report came from a high official in the Executive Branch who wanted to expose Diebold.

Seder vs. Maron: The comeback ?

It sounds like an idea so obviously stupid-proof that it almost couldn't possibly have come from the executive office at Air America Media.

Exiled hosts Marc Maron and Sam Seder re-launched their video podcast program last Friday, and to celebrate, offered up a big announcement. The two will be posting a new show every day between now and the November 4 election, as well as from this week's Democratic National Convention in Denver. And both hosts also stated that they have also been offered a new show on Air America - working as a team.

According to Rebecca O'Malley at The Resilient Rabbit, Maron claimed that the new show, which will supposedly begin in September, will included a number of creative humor elements as well as straight political commentary. Maron may even bring back some of his classic team from his old Morning Sedition show.

So far, that is all that is known about Seder vs. Maron. No time slot has been disclosed, though the most obvious shift would be morning drive, 6-9A ET, which is currently airing previous day replays of other Air America programming.

I still am proud we helped, or at least tried.

At the time I managed to dig up some phone numbers and contacted the make shift airport. I relayed the information and I was later told it helped relief planes arrange landings.

I still kinda wonder if it really happened like that...

WASHINGTON — Disclosure of an election computer glitch that could drop ballot totals for entire precincts is stirring new worries that an unofficial laboratory testing system failed for years to detect an array of flaws in $1.5 billion worth of voting equipment sold nationwide since 2003.

Texas-based Premier Elections Solutions last week alerted at least 1,750 jurisdictions across the country that special precautions are needed to address the problem in tabulation software affecting all 19 of its models dating back a decade.

Voting experts reacted skeptically to the company's assertion that election workers' routine crosschecks of ballot totals would have spotted any instances where its servers failed to register some precinct vote totals when receiving data from multiple memory cards.

Like nearly all of the nation's modern voting equipment, Premier's products were declared "qualified" under a voluntary testing process overseen from the mid 1990s until 2005 by the National Association of State Election Directors.

Computer scientists, some state officials and election watchdog groups allege that the NASED-sponsored testing system was a recipe for disaster, shrouded in secrecy, and allowing equipment makers to help design the tests.

The federal Election Assistance Administration, created in 2002, took over the testing responsibility in 2005, but has yet to certify a single voting machine.

As a result, charged Susan Greenhalgh, a spokeswoman for watchdog group Voter Action, the systems on which Americans will decide the race between Barack Obama and John McCain in November are "scandalously flawed"' and "the integrity of this election is in question."

David Beirne, executive director of the Election Technology Council, which represents the leading makers of voting machines, said there's no reason for concern. Without mentioning NASED, he said that members' products "have all been certified" as meeting 2002 voluntary federal standards.

NASED officials took on the testing in the mid 1990s, after the Federal Election Commission adopted voluntary federal standards for voting machines but Congress failed to create a testing agency. The industry was frustrated, too, by being governed by a hodge-podge of state standards.

"We had two choices: To try to do something or to do nothing," said Thomas Wilkey, who headed NASED's volunteer Voting Systems Committee for several years while executive director of New York's elections board. "We had a set of standards. It was a crime to let them sit on a shelf."

NASED watched over the issuance of "qualified" reports from Independent Testing Laboratories, but with little control over the testing. The vendors secretly negotiated payments with the labs, helped design the tests, got to see the results first and only shared the codes driving their software with three NASED technical experts who signed non-disclosure agreements.

NASED officials posted only "qualified" ratings on the group's Web site.

The lab endorsements aided vendors in selling nearly $1.5 billion in equipment to states and counties from 2003-2007, most of it financed by a gush of federal dollars under the 2002 Help America Vote Act.

Wilkey says the labs' approval was never a "certification." But EAC members have referred publicly to NASED's "certification" of voting machines, and numerous states enacted laws barring purchases of equipment unless it passed the NASED-sponsored tests.

Questions about NASED's testing grew in intensity over the last couple of years, after independent tests for the states of California, New York, Ohio, Florida and Connecticut found performance defects and security gaps in both systems that will serve most voters this fall: touch-screens and optical scanners.

The concerns prompted New York's elections board to scrap a $60 million contract to buy new touch screens to replace its decades-old lever voting machines. Vice Chair Douglas Kellner said it's now clear that a "qualified" rating from NASED is "meaningless ...a piece of toilet paper."

David Jefferson, a voting machine security expert who works at the Lawrence Livermore National Laboratory, said NASED's tests were "of no value if your concern is security against insider threats," such as tampering by election officials.

John Washburn, a software tester in the Milwaukee suburb of Germantown, predicts that nearly all of the machines bought in recent years will have to be replaced in a process he likened to the early 20th Century Teapot Dome scandal "as just the epitome of how government money goes down a rat hole," he said.

Worries about the touch-screens' lack of a verifiable paper trail have already prompted states to replace thousands of barely used machines costing hundreds of millions of dollars in favor of the scanners, which preserve each voter's original paper ballot for use in a recount.

With less than three months before the presidential election, the hotly contested state, Ohio, along with others, continue to have problems with E-voting technology

In their rush to avoid a repeat of the controversy that plagued the 2000 presidential election, and to meet the requirements of Congress's hastily mandated 2002 Help America Vote Act (HAVA), states and counties flocked to electronic voting systems they hoped would eliminate hanging chads and other flaws inherent in paper-based systems. Six years later, with another presidential election less than three months away, many e-voting systems are fraught with security glitches, and the technology has yet to prove itself as the solution voters were looking for.

Such systems could allow voters and poll workers to place multiple votes, crash the systems by loading viruses, and fake vote tallies, according to studies commissioned by the states of California and Ohio within the past year. Makers of these systems have countered that the test settings were unrealistic. But that is not helping election officials sleep better at night.

One of the reasons e-voting systems turned out to be such a failure is that the only people involved in checking these systems were the vendors, who wanted to sell their technology, and the local election officials, who were ill-equipped to understand the security issues, says David Dill, a Stanford University computer science professor and founder of the Verified Voting Foundation, a nonprofit organization pushing for the implementation of voting processes that can more easily be verified and audited. "There was a certification process in place," Dill says, "but it had very little to do with security."

Dill is the author of Attackdog, threat modeling software that can examine more than 9,000 potential ways a voting system can be attacked, including computer hacking, ballot tampering and voter impersonation. Attackdog is part of a larger effort called A Center for Correct, Usable, Reliable, Auditable and Transparent Elections (ACCURATE) , which was launched in 2005 by the National Science Foundation with $7.5 million in funding. "Nothing we do now will affect the November election," Dill says. "We don't know how to make secure paperless voting."

This sentiment is echoed in many places throughout the U.S., most prominently in the hotly contested state of Ohio, where Secretary of State Jennifer Brunner has commissioned a series of tests over the past year to determine whether e-voting systems are secure enough to be trusted. Based on these tests Brunner has concluded that they are not secure, a decision that Premier Election Solutions, Inc., in Allen, Tex., took exception to. Premier sued Brunner and one Ohio county board of elections in May in a move to get the courts to rule that the company had fulfilled its contractual obligations to the state.

Brunner struck back August 6 by countersuing Premier, formerly Diebold Election Systems, Inc., and maker of the touch-screen voting systems into which Ohio has invested more than $62 million since 2005. Brunner's suit accuses Premier of, among other things, breach of contract and breach of warranty, and seeks court acknowledgement that Premier did not honor its contract. The countersuit also asks for damages of at least $25,000 against Premier for voting system malfunctions that have caused problems in at least 11 of the 44 counties using Premier's technology during elections since 2005. "We believe that Premier's equipment has failed to perform as required by its contracts and according to state law," Brunner says. "We have taken this action to recover taxpayer funds spent for voting systems used in half of the state's 88 counties."

Although many states have rejected electronic voting machines because of their vulnerability to errors and outright fraud, a third of the nation will still be using them this fall.

What's worse, notes CNN's Lou Dobbs, "a new report says election officials often are outsourcing their responsibilities to the very companies that make the e-voting machines, even trusting those companies to count the votes."

That report (pdf) was issued by voting rights group VotersUnite.Org, whose founder Ellen Theisen told CNN, "Elections should be accountable to the people and run by public officials who are selected by the people. ... When that's handed over to private vendors, these public elections are no longer public."

The problem is particularly serious when voting machine companies also tabulate the votes, because the companies own both the equipment and the propriety software which runs it and election officials have no way of double-checking their tally.

The VotersUnite report concludes, "The depth of the current dependence is shocking, but even more shocking is the fact that our elections are dependent on vendors whose records reveal their unethical and even unlawful behavior, as well as their incompetence."

Oklahoma is one state which owns its own voting system and wasn't tempted by the offer of federal funds in 2002 to switch over to a proprietary system. "There was really nothing on the market we would buy then," Michael Clingman of the Oklahoma State Election Board told CNN, "and there's still nothing we would want to buy today."

"Oklahoma is a real piece of America!" Dobbs commented approvingly. "They're telling these silly son-of-a-guns to go stick it -- and they're honoring a commitment to the public."

Dobbs promised to post a list of every state or county that is outsourcing the vote on his Web site.

Impeach Bush for Iraq Lies.

On 7/15/08, Rep. Dennis Kucinich introduced H.Res. 1345, one Article of Impeachment Against President Bush.

H.Res. 1345 says Bush should be impeached because he "deceived Congress with fabricated threats of Iraq Weapons of Mass Destruction (WMD) to fraudulently obtain support for an authorization for the use of force against Iraq and used that fraudulently obtained authorization, then acting in his capacity under Article II, Section II of the Constitution as Commander in Chief, to commit US troops to combat in Iraq."

The evidence that Rep. Kucinich has presented for this charge is overwhelming. It is imperative to Impeach George Bush both to hold him accountable for his crimes and to deter future Presidents from committing similar crimes.

It sickens me to think that Zoe Baird and Kimba Wood were disqualified as choices for Attorney General because of nanny taxes and yet we get Attorneys General who believed in stomping on the Constitution (Ashcroft), approve of voter suppression and torture as well as lie to Congress and reporters (Gonzales) and who think torture is only torture if it is done to him, won’t prosecute or investigate crimes committed by the Executive Branch and now thinks that not all violations of the law are crimes (Mukasey).

Thanks for that last one, Senators Schumer and Feinstein.

Whether you look at the "regular" definition of the word "crime" or even the legal definition, you will find the most basic "violation of law" as part of the definition.

But this isn’t just to point out that the current Attorney General is willing to say that not every crime is a crime in trying to stretch the boundaries of reality so far as to not prosecute...um....hmmm....what’s the word....oh yeah....crimes by members of his own Justice Department, it is to wonder just what other crimes, I mean "violations of the law" are just peachy keen according to the man who only holds the title and position of the nation’s top law enforcement official.

We know that violating the fourth amendment (which is of higher authority that "a law") is not a crime;
We know that ignoring subpoenas by Congress is not a crime (disclaimer: IOKIYAR);
We know that politicizing the internship program at the Justice Department is not a crime;
We know that waterboarding another individual isn’t a crime (unless it is done to him);
We know that destroying taped evidence of torture, after being ordered not to), is not a crime;
We know that top Executive Branch officials ordering torture isn’t a crime;
We know that suppressing people’s right to vote is not a crime;
We will probably soon find out that violating FEC campaign finance rules is not a crime (again, IOKIYAR);
We also know that violating the habeas corpus rules is also not a crime;
We know that lying to Congress is not a crime; and
For good measure, covering for the President himself over potential crimes, er, "violations of law" that the President may have committed is most certainly not a crime.
I’m sure that I missed more than a few, but I am glad that having a funny sounding name or names that sound similar to names that sound funny are worthy of indefinite detaining or "errors". And living in a house that wasn’t even the house that SWAT teams were supposed to be looking for is their own fault when they are raided or wrongfully arrested.


Torture. Fabricate evidence to invade another country. Violate laws in hiring and firing practices. Suppress the vote illegally. Violate the fourth amendment. Blow the cover of a covert CIA operative and an entire network of people working on WMD issues. Break campaign finance laws. Ignore subpoenas.


Go ahead - those aren’t crimes and there certainly is a precedent for not being prosecuted.

Just don’t wear a shirt that has a cartoon robot on it while trying to fly or, even worse, wear a t shirt that says "Give Peace A Chance". Because those are not only most certainly not in any way violations of the law, but are also crimes.

Mukasey is no Elliot Richardson...

US Attorney General Mukasey apparently forgets that he works for the American people, not for the White House. He also forgets we are a country of laws, not of men. So his latest shocker is not only a cover-up, politically based and with complete disregard for the law, but it is also obstruction of justice, for which he should be prosecuted. From Think Progress:

In a speech today before the American Bar Association (ABA), Mukasey was more explicit in his rejection of any sort of review or prosecution, saying that the “negative publicity” they faced was enough:

That does not mean, as some people have suggested, that those officials who were found by the joint reports to have committed misconduct have suffered no consequences. Far from it. The officials most directly implicated in the misconduct left the Department to the accompaniment of substantial negative publicity. … To put it in concrete terms, I doubt that anyone in this room would want to trade places with any of those people.

Mukasey also reiterated that these former employees were not found to be in violation of any criminal laws. They did, however, violate civil service laws. A joint report by the Inspector General and the Office of Professional Responsibility found that in particular, Michael Elston, formerly the chief of staff to the Deputy Attorney General, “violated federal law and Department policy” by selecting candidates based on their political affiliations.

Clearly, the Bush administration seems to be betting that it will be able to escape any accountability for its misdeeds once it leaves office. In the meantime, officials are just running out the clock.

Well then, next time any American citizen breaks the law, feel free to cite Mukasey's (unofficial) ruling (as a judge?) that embarrassment is more than enough punishment. I also find it remarkable that Mukasey thinks that this entire scandal is about DOJ officials and their hiring practices. What of the US Attorneys who have and continue to abuse their power in targeting Democrats, and in some cases cooking the evidence against them? What of those alleged crimes and the victims of those crimes? Senator Schumer should feel ashamed for his role in getting Mukasey seated as the AG.

Imagine for a moment if this had occurred under Bill Clinton's watch!

The greatest catastrophe in US history, followed by the worst administration in US history,
and yet...he still has a 30% approval rating, while only 13% feel that we're headed in the "right" direction.

There she was on The View on Monday, and Joy Behar, a good progressive, actually asked her a decent question on why she wasn’t pursuing impeachment.

Pelosi’s response was unbelievable: “If somebody had a crime that the president had committed, that would be a different story.”

You’ve got to be kidding me!

For starters, Bush himself admitted that he wasn’t obeying the FISA law when he was spying on people without first getting a warrant from the FISA court as required explicitly in the statute.

Then there is the torture and kidnapping that he has countenanced. That violates U.S. statutes and treaties.

And what about the wholesale corrupting of the Justice Department, which pursued political prosecutions and illegally discriminated against prospective employees on the basis of their personal views?

Then there’s the outing of Valerie Plame, and the cover up of that outing.

And what greater crime can you commit than waging a war of aggression and lying a country into war?

The evidence on impeachment, as Dennis Kucinich has courageously and thoroughly demonstrated, is overwhelming. On Democracy Now, Kucinich responded to Pelosi’s claim.

"Mr. Chairman," Baldwin continued, "there are those who would say that holding this hearing - examining whether or not the president and vice president broke the law - is frivolous. I not only reject this, I believe there is no task more important for this Congress than to seriously consider whether our nation's leaders have violated their oath of office. The American public expects no less. It is, after all, their Constitution. No president or congress has the authority to override that document, whereby ëWe the People' conferred upon the branches of government limited and defined power, and provided for meaningful checks and balances."

Now THAT'S quotable. I hope Congresswoman Baldwin got a soundbite on the news shows. NO?

Well then, shout it from the rooftops:

"[of the]Constitution. No president or congress has the authority to override that document...."

When Nancy Pelosi says she sees no evidence of lawbreaking(so that means also she will approve no process whereby that evidence can come forward, be put to the test, and be verified?!). like Bush/Cheney, she TOO is is PRETENDING she "has the authority to override" the Constitution!!

Pelosi has NO Authority to do what she is doing; she has no authority (I don't care if she is third in line for succession) to be UNITARY THIRD IN-LINE!!
