Supreme Court upholds photo ID law for voters in Indiana.

WASHINGTON - The Supreme Court ruled Monday that states can require voters to produce photo identification without violating their constitutional rights, validating Republican-inspired voter ID laws.

In a splintered 6-3 ruling, the court upheld Indiana's strict photo ID requirement, which Democrats and civil rights groups said would deter poor, older and minority voters from casting ballots. Its backers said it was needed to prevent fraud.

It was the most important voting rights case since the Bush v. Gore dispute that sealed the 2000 election for George W. Bush. But the voter ID ruling lacked the conservative-liberal split that marked the 2000 case.

The law "is amply justified by the valid interest in protecting 'the integrity and reliability of the electoral process,'" Justice John Paul Stevens said in an opinion that was joined by Chief Justice John Roberts and Anthony Kennedy. Stevens was a dissenter in Bush v. Gore in 2000.

Justices Samuel Alito, Antonin Scalia and Clarence Thomas also agreed with the outcome, but wrote separately.

Justices Stephen Breyer, Ruth Bader Ginsburg and David Souter dissented, just as they did in 2000.

More than 20 states require some form of identification at the polls. Courts have upheld voter ID laws in Arizona, Georgia and Michigan, but struck down Missouri's. Monday's decision comes a week before Indiana's presidential primary.

The decision also could spur efforts to pass similar laws in other states.

Ken Falk, legal director of the American Civil Liberties Union of Indiana, said he hadn't reviewed the decision, but he was "extremely disappointed" by it. Falk has said voter ID laws inhibit voting, and a person's right to vote "is the most important right." The ACLU brought the case on behalf of Indiana voters.

The case concerned a state law, passed in 2005, that was backed by Republicans as a way to deter voter fraud. Democrats and civil rights groups opposed the law as unconstitutional and called it a thinly veiled effort to discourage elderly, poor and minority voters — those most likely to lack proper ID and who tend to vote for Democrats.

There is little history in Indiana of either in-person voter fraud — of the sort the law was designed to thwart — or voters being inconvenienced by the law's requirements. For the overwhelming majority of voters, an Indiana driver license serves as the identification.

"We cannot conclude that the statute imposes 'excessively burdensome requirements' on any class of voters," Stevens said.

Stevens' opinion suggests that the outcome could be different in a state where voters could provide evidence that their rights had been impaired.

But in dissent, Souter said Indiana's voter ID law "threatens to impose nontrivial burdens on the voting rights of tens of thousands of the state's citizens."

Scalia, favoring a broader ruling in defense of voter ID laws, said, "The universally applicable requirements of Indiana's voter-identification law are eminently reasonable. The burden of acquiring, possessing and showing a free photo identification is simply not severe, because it does not 'even represent a significant increase over the usual burdens of voting.'"

Stevens said the partisan divide in Indiana, as well as elsewhere, was noteworthy. But he said that preventing fraud and inspiring voter confidence were legitimate goals of the law, regardless of who backed or opposed it.

Indiana provides IDs free of charge to the poor and allows voters who lack photo ID to cast a provisional ballot and then show up within 10 days at their county courthouse to produce identification or otherwise attest to their identity.

Stevens said these provisions also help reduce the burden on people who lack driver licenses.

60 Percent Of EPA Staff Have ‘Personally Experienced’ ‘Political Interference’»
Today, the Union of Concerned Scientists (UCS) released a report detailing the increasing politicization of the Environmental Protection Agency (EPA). Of the nearly 1,600 EPA staff scientists surveyed, 889 of them — 60 percent — “said they had personally experienced at least one instance of political interference in their work over the last five years.” Other key findings from the report:

– 394 scientists (31 percent) personally experienced frequent or occasional “statements by EPA officials that misrepresent scientists’ findings.”

– 285 scientists (22 percent) said they frequently or occasionally personally experienced “selective or incomplete use of data to justify a specific regulatory outcome.”

– 224 scientists (17 percent) said they had been “directed to inappropriately exclude or alter technical information from an EPA scientific document.”

– Hundreds of scientists reported being unable to openly express concerns about the EPA’s work without fear of retaliation; 492 (31 percent) felt they could not speak candidly within the agency and 382 (24 percent) felt they could not do so outside the agency.

What’s more, among the various offices and divisions of the EPA, the National Center for Environmental Assessment — “where scientists conduct risk assessments that could lead to strengthened regulations” — had the highest percentage of scientists reporting interferences, at 84 percent. This is unsurprising, considering that some of the highest profile examples of prioritizing ideology over science have occurred when the White House wants to weaken environmental regulation

Risk of depression dims hopes for anti-addiction pills

CHICAGO - Two years ago, scientists had high hopes for new pills that would help people quit smoking, lose weight and maybe kick other tough addictions like alcohol and cocaine.

The pills worked in a novel way, by blocking pleasure centers in the brain that provide the feel-good response from smoking or eating. Now it seems the drugs may block pleasure too well, possibly raising the risk of depression and suicide.

Margaret Bastian of suburban Rochester, N.Y., was among patients who reported problems with Chantix, a highly touted quit-smoking pill from Pfizer Inc. that has been linked to dozens of reports of suicides and hundreds of suicidal behaviors.

"I started to get severely depressed and just going down into that hole ... the one you can't crawl out of," said Bastian, whose doctor took her off Chantix after she swallowed too many sleeping pills and other medicines one night.

Side effects also plague two other drugs:

• Rimonabant, an obesity pill sold as Acomplia in Europe, was tied to higher rates of depression and a suicide in a study last month. The maker, Sanofi-Aventis SA, still hopes to win its approval in the United States.

• Taranabant, a similar pill in late-stage testing, led to higher rates of depression and other side effects in a study last month. Its maker, Merck & Co., stopped testing it at middle and high doses.

The makers of the new drugs insist they are safe, although perhaps not for everyone, such as people with a history of depression. Having to restrict the drugs' use would be a big setback because it would deprive the very people who need help the most, since addictions and depression often go hand-in-hand, doctors say.

WASHINGTON - Short-term exposure to smog, or ozone, is clearly linked to premature deaths that should be taken into account when measuring the health benefits of reducing air pollution, a National Academy of Sciences report concluded Tuesday.

The findings contradict arguments made by some White House officials that the connection between smog and premature death has not been shown sufficiently, and that the number of saved lives should not be calculated in determining clean air benefits.

The report by a panel of the Academy's National Research Council says government agencies "should give little or no weight" to such arguments.

"The committee has concluded from its review of health-based evidence that short-term exposure to ambient ozone is likely to contribute to premature deaths," the 13-member panel said.

It added that "studies have yielded strong evidence that short-term exposure to ozone can exacerbate lung conditions, causing illness and hospitalization and can potentially lead to death."

The White House Office of Management and Budget, which in its review of air quality regulations has raised questions about the certainty of the pollution and mortality link, did not immediately return a phone call seeking comment.

"The report is a rebuke of the Bush administration which has consistently tried to downplay the connection between smog and premature death," said Frank O'Donnell, president of Clean Air Watch, a Washington-based advocacy organization.

God,

My boy came back from Iraq with one less leg and only 2 fingers on his left hand. I used to joke with him he was never good with his hands but he was always good with the books. He wants to go to college but can't do it on his disability payments (which got cut recently). Hell, I got drafted to go to 'Nam and had full G.I. benefits for college but was too dumb to use them. Now he volunteers, does 3 tours in Iraq and gets squat.

John McCain won't vote for G.I. Educational benefits even though he used them to get his law degree.

What the fuck is wrong with that man God?

Sorry 'bout the language, I'm bitter but you knew that anyway, after all you are God.

If I can get some gas in the truck I promise to make it to church this week. Don't worry about the bullets. It's no fun huntin' without my boy anyway.

CA.Secretary of State Debra Bowen

A former sales representative for the company that made the county's electronic voting machines has been hired as the county's registrar of voters.
In 2003, the county bought 10,000 electronic voting machines from Diebold Election Systems. The county's new registrar, Deborah Seiler, said Friday that she worked as sales representative for the company and was directly involved in the successful effort to sell the company's equipment to the county in 2003.

Between 1991 and 1999, Seiler worked as director of customer relations for the electronic voting machine company, Sequoia Pacific Systems. She also served as a commissioner with the California Fair Political Practices Commission between 1993 and 1997.

In San Diego County, many of the questions surrounding recent elections -- and the hiring of Seiler -- involve electronic voting machines made by Diebold.

Diebold sold more than 10,000 of the machines to the county at a total cost of $31 million.

When Diebold's contract comes up for renewal or there are disagreements, is she going to represent her former company or the citizens of San Diego County?" Simpkins asked when contacted by the North County Times on Friday.

Seiler has served for the last three years as the assistant registrar of voters in Solano County. She will start as the new local elections chief next month and earn an annual salary of $150,000, she said.
Seiler's hiring was the second decision by the county in the last month or so to raise questions from election watchdogs. In April, county officials announced that they were giving the job of assistant registrar of voters to former Cuyahoga County Ohio elections chief Michael Vu, who served in that position for three and a half years.

During his tenure, the county gained national notoriety when a federal judge in Cleveland ordered 16 Cuyahoga County polling stations to stay open 90 minutes after the 7:30 closing time in November's elections because of voting machine problems and long waiting lines for voters.

In January, a court convicted two elections workers in that county of illegally rigging the 2004 presidential election recount so they could avoid a more complete review of votes. Vu defended the workers, saying they had followed long-standing procedures and done nothing wrong.

Haas said Friday that he was instrumental in hiring Seiler and he believes that the county has found a "gem."

"Her depth and breadth of knowledge of elections in California for over 27 years was the absolute driving point in hiring her," Haas said.

Asked if Seiler's association with Diebold played a role in the decision to hire her, Haas said: "We use that system, so it's kind of a plus."
