A federal judge in Oregon has ruled that a Montana woman sued for defamation was not a journalist when she posted online that an Oregon lawyer acted criminally during a bankruptcy case, a decision with implications for bloggers around the country.
Crystal L. Cox, a blogger from Eureka, Mont., was sued for defamation by attorney Kevin Padrick when she posted online that he was a thug and a thief during the handling of bankruptcy proceedings by him and Obsidian Finance Group LLC.
U.S. District Judge Marco Hernandez found last week that as a blogger, Cox was not a journalist and cannot claim the protections afforded to mainstream reporters and news outlets.
Although media experts said Wednesday that the ruling would have little effect on the definition of journalism, it casts a shadow on those who work in nontraditional media since it highlights the lack of case law that could protect them and the fact that current state shield laws for journalists are not covering recent developments in online media.

first month of the Occupy Wall Street movement. While a small handful of them have been
charged with various acts of mayhem, the vast majority were peacefully demonstrating.
They were arrested for not complying with orders to disperse, or for refusing to tear down
the encampments that have come to symbolize the movement. We have a right to peacefully
assemble and protest in this country, so what gives?
On its face, “occupying” public space should be guaranteed under the First Amendment.

August 24, 2011 "Information Clearing House" -- -- -In a few days it will be the tenth anniversary of September 11, 2001. How well has the US government’s official account of the event held up over the decade?
Not very well. The chairman, vice chairman, and senior legal counsel of the 9/11 Commission wrote books partially disassociating themselves from the commission’s report. They said that the Bush administration put obstacles in their path, that information was withheld from them, that President Bush agreed to testify only if he was chaperoned by Vice President Cheney and neither were put under oath, that Pentagon and FAA officials lied to the commission and that the commission considered referring the false testimony for investigation for obstruction of justice.
In their book, the chairman and vice chairman, Thomas Kean and Lee Hamilton, wrote that the 9/11 Commission was “set up to fail.” Senior counsel John Farmer, Jr., wrote
that the US government made “a decision not to tell the truth about what happened,” and that the NORAD “tapes told a radically different story from what had been told to us and the public.” Kean said, “We to this day don’t know why NORAD told us what they told us, it was just so far from the truth.”
Most of the questions from the 9/11 families were not answered. Important witnesses were not called. The commission only heard from those who supported the government’s account. The commission was a controlled political operation, not an investigation of events and evidence. Its membership consisted of former politicians. No knowledgeable experts were appointed to the commission.
One member of the 9/11 Commission, former Senator Max Cleland, responded to the constraints placed on the commission by the White House: “If this decision stands, I, as a member of the commission, cannot look any American in the eye, especially family members of victims, and say the commission had full access. This investigation is now compromised.” Cleland resigned rather than have his integrity compromised.
To be clear, neither Cleland nor members of the commission suggested that 9/11 was an inside job to advance a war agenda. Nevertheless, neither Congress nor the media wondered, at least not out loud, why President Bush was unwilling to appear before the commission under oath or without Cheney, why Pentagon and FAA officials lied to the commission or, if the officials did not lie, why the commission believed they lied, or why the White House resisted for so long any kind of commission being formed, even one under its control.
One would think that if a handful of Arabs managed to outwit not merely the CIA and FBI but all 16 US intelligence agencies, all intelligence agencies of our allies including Mossad, the National Security Council, the State Department, NORAD, airport security four times on one morning, air traffic control, etc., the President, Congress, and the media would be demanding to know how such an improbable event could occur. Instead, the White House put up a wall of resistance to finding out, and Congress and the media showed little interest.
During the decade that has passed, numerous 9/11 Truth organizations have formed.
There are Architects and Engineers for 9/11 Truth, Firefighters for 9/11 Truth, Pilots for 9/11 Truth, Scholars for 9/11 Truth, Remember Building 7.org, and a New York group which includes 9/11 families. These groups call for a real investigation.
David Ray Griffen has written 10 carefully researched books documenting problems in the government’s account. Scientists have pointed out that the government has no explanation for the molten steel. NIST has been forced to admit that WTC 7 was in free fall for part of its descent, and a scientific team led by a professor of nano-chemistry at the University of Copenhagen has reported finding nano-thermite in the dust from the buildings.
Larry Silverstein, who had the lease on the World Trade Center buildings, said in a PBS broadcast that the decision was made “to pull” Building 7 late in the afternoon of 9/11. Chief fire marshals have said that no forensic investigation was made of the buildings’ destruction and that the absence of investigation was a violation of law.
Some efforts have been made to explain away some of the evidence that is contrary to the official account, but most of the contrary evidence is simply ignored. The fact remains that the skepticism of a large number of knowledgeable experts has had no effect on the government’s position other than a member of the Obama administration suggesting that the government infiltrate the 9/11 truth organizations in order to discredit them.
The practice has been to brand experts not convinced by the government’s case “conspiracy theorists.” But of course the government’s own theory is a conspiracy theory, an even less likely one once a person realizes its full implication of intelligence and operational failures. The implied failures are extraordinarily large; yet,

Murdoch tabloid private eye delivers hacking names

LONDON (Reuters) – A private detective jailed for illegally intercepting voicemail messages on behalf of a journalist at one of Rupert Murdoch's British tabloids on Friday gave lawyers the names of the people he says ordered him to carry out the phone hacking.
Glenn Mulcaire's lawyer, Sarah Webb, said no details would be released before legal moves by her next week to prevent their publication while a police probe continues into allegations of phone hacking by the now closed News of the World newspaper.
Disclosure of the names would add pressure on News International, the British newspaper arm of Murdoch's News Corp and shed further light on how widespread phone hacking was at the tabloid.
Mulcaire, jailed in 2007 along with paper's royal reporter Clive Goodman, had been ordered to hand over the details by a court judge.
Webb said the document containing the names had been delivered late on Friday to lawyers representing actor Steve Coogan, who had sought the disclosure from Mulcaire.
She would not say how many names were contained in the document. News International had maintained until recently that phone hacking was limited to a single rogue reporter.

Disclosure of the names would add pressure on News International, the British newspaper arm of Murdoch's News Corp and shed further light on how widespread phone hacking was at the tabloid.
Mulcaire, jailed in 2007 along with paper's royal reporter Clive Goodman, had been ordered to hand over the details by a court judge.
Webb said the document containing the names had been delivered late on Friday to lawyers representing actor Steve Coogan, who had sought the disclosure from Mulcaire.
She would not say how many names were contained in the document. News International had maintained until recently that phone hacking was limited to a single rogue reporter.

Around the country, broadcasters are using sneaky legal deals and loopholes to evade the FCC’s media ownership rules. This “covert consolidation” takes many forms, but the results are the same: Media companies pad their bottom line by sacrificing local journalism, competition and diversity.
As the FCC reviews its media ownership rules, tell it that you won’t stand for stations polluting your community with photocopy journalism and junk news. Covert consolidation has to go. It’s time to change the channels.

A self-described "armchair astronaut" claims to have found a base on the planet Mars using a satellite imaging map. He thinks the base could have been made by aliens
The video David Martines uploaded to YouTube has been viewed more than 850,000 times. He says the 750'-by-150' cylinder-like structure that he's zoomed in on using Google Mars looks like it's made for people to inhabit. In the video, Martines say he assumes people live in the cylinder or have lived in it.
He named the shape "Bio Station Alpha." Experts told Space.come that the image was most likely caused by "cosmic energy" interfering with the cameras--not by aliens.
"It looks like a linear streak artifact produced by a cosmic ray," Alfred McEwen, a planetary geologist at the University of Arizona told Space.com. Cosmic rays, which are emitted by the Sun and other stars, don't make it to Earth because of its magnetosphere. "But with space images that are taken outside our magnetosphere, such as those taken by orbiting telescopes, it's very common to see these cosmic ray hits. You see them on optical images and a lot of the infrared images too."

Sen. John Ensign sex scandal spreads to other Republicans

The sordid tale of former Sen. John Ensign (R) of Nevada is casting its dark ethical – and perhaps legal – shadow wider and wider in Washington.
Aside from the likelihood that Ensign will face criminal charges, recent revelations don’t paint a very good picture of Sen. Tom Coburn, former senator and presidential candidate Rick Santorum, nor the Justice Department.
When details of his affair with the wife of a former staffer and close family friend revealed what looked to many observers like a cover-up – including the payment of large sums of money via his parents – Ensign announced that he would not run for reelection. Then last week he abruptly resigned his seat in order to avoid having to personally face a Senate Ethics Committee investigation and his likely expulsion from the Senate.
Å“Based on the record in this matter, the Special Counsel respectfully submits that there is substantial credible evidence that provides substantial cause to conclude that Senator Ensign violated Senate Rules and federal civil and criminal laws, and engaged in improper conduct reflecting upon the Senate, thus betraying the public trust and bringing discredit to the Senate,â€
Among other things, the report alleges that Ensign and his parents made illegal payments to his mistress and her husband, made false or misleading statements to the Federal Election Commission, and â€Å“permitted spoliation [alteration or destruction] of documents and engaged in potential obstruction of justice violations.â€
The committee has referred the matter to the Justice Department and the Federal Election Commission.
Critics wonder why the Justice Department appears not to have pursued the Ensign case with any sense of vigor. Last December, the Justice Department informed Ensign's lawyers that he was "no longer a target" in a corruption probe.
“It is puzzling how DOJ, armed with the full might of the legal system, was unwilling or unable to reach the same conclusions as the ethics committee,” said Melanie Sloan, executive director of the watchdog group Citizens for Responsibility and Ethics in Washington, in a statement. “Perhaps this report will give DOJ the spine it so clearly lacks, and the courage to finally take on Senator Ensign.”
"It is only a question of when the government is going to indict," Douglas McNabb, a federal criminal defense attorney, told the Las Vegas Review-Journal Friday. "I don't understand why they set it aside before."
Meanwhile, Ensign’s personal disgrace and political downfall appears to have touched at least two of his Senate colleagues.
Former Sen. Rick Santorum (R) of Pennsylvania – who lost his reelection bid in 2006 and is now running for president on a platform stressing family values – learned of the Ensign affair in an email from Doug Hampton, Ensign’s former chief of staff and husband of Ensign’s mistress Cynthia Hampton.
Hampton reportedly was seeking Santorum’s help. But rather than reply to Hampton, Santorum forwarded the email to Ensign, tipping him off to the impending scandal.
As the episode continued, Sen. Tom Coburn (R) of Oklahoma became involved in negotiating financial payment to the Hamptons (which involved Ensign’s parents) – apparently as a way of settling the situation in a way that would limit political damage.
As the Senate Ethics Committee report details, there’s much more to the story – including Ensign’s trying to generate lobbying business for Mr. Hampton after Hampton was pushed out of his job working for the Nevada senator.
None of it is likely to do any good to the reputation of Sen. Coburn or to the presidential ambitions of Mr. Santorum.

Dear Friend,
President Obama and Senate Majority Leader Harry Reid announced a deal with Republicans on the budget that averted a government shutdown while fending off some of the biggest attacks on women and the environment. But shockingly, Speaker Boehner emerged from the negotiations with billions more in cuts than he initially asked for.
There is no way to describe the Democrats' disastrous negotiating strategy other than one of appeasement.
In effect, the Republicans took hostages and, in response, Democratic leadership agreed to pay a very high ransom.
As a result, Republicans are newly emboldened. And they have already boasted about the price they will exact from Democrats in the coming fights over the 2012 budget and the debt ceiling.
I just signed a petition telling President Obama to stop caving to hostage takers, make a stand on the debt ceiling and take Medicare off the table. I hope you'll sign it too.

The cataclysm in Japan pushed it off the front page, but last Friday was a landmark day in America as Wisconsin Gov. Scott Walker signed into law a controversial bill restricting the collective bargaining rights of public sector unions.
There's been a lot of talk, here and elsewhere, about whether the standoff in Wisconsin was about pure economics or partisan politics. (See: Wisconsin Lt. Gov: This Is About Balancing the Budget, Not Political Payback)
"It's pretty clear there's an agenda nationwide: Republican governors backed by the Koch Brothers [and] extreme right wing money want to crush the unions," says Columbia Professor Jeffrey Sachs. "The public is against it, but public opinion doesn't count much in this country these days." (Editor's note: The Koch Brothers have denied our repeated requests for an interview.)
But Sachs says the "real story" is much bigger than Wisconsin: It's about stagnant wages of public and private sector workers alike, and the increasing and increasingly pernicious role of big money in politics.
The following statistics speak to Sachs' first point:
Since 1973, the median take home pay of full-time workers is virtually unchanged on an inflation-adjusted basis.
The top 11,000 households in America have more income than the bottom 25 million.
Since 1976, 58% of real income growth has gone to the top 1% of Americans.
"We've reached the greatest income [and] wealth inequality in history," Sachs says. "This is a new ‘Robber Baron' era, of course."
And just like the titans of industry in 19th century America, "the people at the top buy the politicians," he laments. "All of them - all parties. Everyone is in the hands of the super wealthy." (See: D.C. Disconnect: Congress Represents Big Interests, Not YOUR Interests, Sachs Says)
Decrying a "shocking game that got out of hand," Sachs notes President Obama is seeking to raise $1 billion for his presumed reelection bid. NASA scientist finds evidence of alien life !

Aliens exist, and we have proof.
That astonishingly awesome claim comes from Dr. Richard B. Hoover, an astrobiologist at NASA’s Marshall Space Flight Center, who says he has found conclusive evidence of alien life — fossils of bacteria found in an extremely rare class of meteorite called CI1 carbonaceous chondrites. (There are only nine such meteorites on planet Earth.) Hoover’s findings were published late Friday night in the Journal of Cosmology, a peer-reviewed scientific journal.
“I interpret it as indicating that life is more broadly distributed than restricted strictly to the planet earth,” Hoover, who has spent more than 10 years studying meteorites around the world, told FoxNews.com in an interview. “This field of study has just barely been touched — because quite frankly, a great many scientist would say that this is impossible.”
Hoover discovered the fossils by breaking apart the CI1 meteorite, and analyzing the exposed rock with a scanning-electron microscope and a field emission electron-scanning microscope, which allowed him to detect any fossil remains. What he found were fossils of micro-organisms (pictured below), many of which he says are strikingly similar to those found on our own planet (pictured above).
“The exciting thing is that they are in many cases recognizable and can be associated very closely with the generic species here on earth,” said Hoover. Some of the fossils, however, are quite odd. “There are some that are just very strange and don’t look like anything that I’ve been able to identify, and I’ve shown them to many other experts that have also come up stump.”

“Given the controversial nature of his discovery, we have invited 100 experts and have issued a general invitation to over 5,000 scientists from the scientific community to review the paper and to offer their critical analysis,” writes Harvard-Smithsonian Center for Astrophysics scientist Dr. Rudy Schild, who serves as the Journal of Cosmology’s editor-in-chief. “No other paper in the history of science has undergone such a thorough vetting, and never before in the history of science has the scientific community been given the opportunity to critically analyze an important research paper before it is published.”
Needless to say, if Hoover̢۪s conclusions are found to be accurate, the implications for human life will be staggering. Here̢۪s hoping that he̢۪s right.
Update: While the Journal of Cosmology says that “no other paper in the history of science has undergone such a thorough vetting,” some highly respected names in the scientific community are challenging the validity of Cosmology, and the findings of Dr. Hoover.
“[The Journal of Cosmology] isn’t a real science journal at all,”
says PZ Meyers in Science Blogs, “but is the ginned-up website of a small group of crank academics obsessed with the idea of Hoyle and Wickramasinghe that life originated in outer space and simply rained down on Earth.”
So there you have it — this is either reality-altering news, or the work of kooks. Our hearts believe, but our brains are kind of bummed.

Aliens exist, and we have proof.
That astonishingly awesome claim comes from Dr. Richard B. Hoover, an astrobiologist at NASA’s Marshall Space Flight Center, who says he has found conclusive evidence of alien life — fossils of bacteria found in an extremely rare class of meteorite called CI1 carbonaceous chondrites. (There are only nine such meteorites on planet Earth.) Hoover’s findings were published late Friday night in the Journal of Cosmology, a peer-reviewed scientific journal.
“I interpret it as indicating that life is more broadly distributed than restricted strictly to the planet earth,” Hoover, who has spent more than 10 years studying meteorites around the world, told FoxNews.com in an interview. “This field of study has just barely been touched — because quite frankly, a great many scientist would say that this is impossible.”
Hoover discovered the fossils by breaking apart the CI1 meteorite, and analyzing the exposed rock with a scanning-electron microscope and a field emission electron-scanning microscope, which allowed him to detect any fossil remains. What he found were fossils of micro-organisms (pictured below), many of which he says are strikingly similar to those found on our own planet (pictured above).
“The exciting thing is that they are in many cases recognizable and can be associated very closely with the generic species here on earth,” said Hoover. Some of the fossils, however, are quite odd. “There are some that are just very strange and don’t look like anything that I’ve been able to identify, and I’ve shown them to many other experts that have also come up stump.”

The demonstrations in Egypt have captured and held my interest since their inception. Today I wondered why.
Sure, it is current events and falls squarely in the wheelhouse of political geekdom, so there’s no surprise there. The Arab/Persian world is the new Evil Empire according to people on my right, so I feel a certain obligation to pay attention to any news from the eastern Mediterranean to Afghanistan, but my fascination goes beyond Mideast affairs.
It’s simply this: The many are making changes without guidance from a few.
Ten days of demonstrations in Egypt is the exception to the rule that cats can’t be herded. Even better, they don’t need a shepherd. Egyptians are doing what all of us wish we could do to oppose corporate powers. Egyptians are doing what all of us wish we could do to oppose political nonsense. Egyptians are doing what all of us wish we could do to oppose stupid wars.
And they have agreed amongst themselves to do it peacefully. They have attacked an unwanted system by using the most righteous weapons possible: Numbers and publicity and determination.
That’s the key fascination for me. Egyptians are turning their frustrations into something tangible and effective. My frustrations simmer. My frustrations are expressed in a voting booth, or with a phone call or email, or by trying to explain complexities to someone who is poorly informed or apathetic or both. None of it is tangible or effective. Tomorrow I will be as frustrated as I am today. I am one voice howling at the moon.
But numbers, ah, numbers…with numbers demonstrating for days on end, something happens. It might not be a “better” something but it will be a something of their own doing…without instruction from above.
*The recent events in Egypt are an example of what rarely happens yet what everyone wishes would happen more often:
The few openly confronted by the unyielding many. No blood lust. No threats beyond “We will all stay right here, as a unified group, until you go away.”
My fascination is constructed of my own frustration and cynicism.
“Yes, Virginia, there IS a Santa Claus.” …and he lives in Egypt.

Keith Olbermann was just fired by MSNBC. According to Keith, he received notice that "this is going to be the last edition of your show," and bam, he was out the door.
Keith's commentaries gave voice to our hopes and our fears. He helped so many of us survive the Bush years, and while a staunch Obama supporter, he wasn't afraid to stand up to his own President either.
We will all miss Keith, and wish him well wherever he ends up next.
